Porto Cima Townhouse Property Owners Association Board Meeting April 1, 2007

Attending: Board members Don Brohm, Lee Eise, Bill Manion, Jim Barnett, Jane Kruse (by speaker phone), POA Manager Todd Nelson, and Linda Eise (recorder).
Absent: All were present.
Approval of November 4, 2006 Annual Meeting Minutes. A motion was made to approve the minutes of the November Annual meeting by Jim Barnett. Bill Manion seconded the motion. The motion was approved.

Financial Report: The year end 2006 financial report was approved. Subsequent to this approval, and the board meeting, it was determined the report needed to be revised to include dryvit repair bills for work completed in 2006. These bills were just received for payment. These expenses should be included in the 2006 financial report. Policy on common ground repair: This issue was raised by failures/breaks in the water pipes feeding several different units, who is responsible for repairs? Jane said that three feet out from the foundation is the property line where the common ground begins, is the property owners responsibility. The common area should be the association’s responsibility. Todd stated he was aware of three issues and the POA has not covered any of the repair costs. They were all warranty issues. Four Seasons has covered repairs in the past two cases were the connection has broken at the underground pipe that connects with blue polyethylene in the home. The board concluded that in the future, if it is not a warranty issue and is on the common ground the association will cover the repair expense. If it is on the three feet inside the property line it is the owner’s responsibility. This is only an issue with water/sewer because phone, electric and cable TV providers cover the facilities right to the home. The water company only covers the main to the meter junction box usually located in the middle of the common ground on the street side of the building. Todd will look into finding out who’s responsible for sewer repair issues. [NOTE: This item was corrected on 8/20/07 changing the location of the property line from 2 ft out from the foundation to 3 ft. This correction was based on a review of an actual plot plan with Joe Roeger of First Title Insurance Agency.]
Todd will remind Homeowners to call if they are going to be digging, to put in a tree etc, they need POA permission, and are responsible to contact “Missouri one call” to get all underground lines marked.
Roof Leaks: Todd said they have had a few owners call about roof leaks. The POA has covered the past few. One had minimal damage inside.
Don suggested we advance having the roof inspections done as we had a hard winter. Todd has asked who is responsible for any inside damage caused by a leaking roof? During discussion, it was agreed primary responsibility is the homeowner insurance, with the POA covering the deductible. It was also agreed that the owner would be responsible for extensive damage that could be caused by a leak not detected earlier due to the absence of the owner for an extended period. It is the owner’s responsibility to arrange for interior inspection during long absences to be sure heat remains on, and water is not leaking from pipes or the roof.
The board agreed the inspection of roofs should commence immediately due to the harsh winter. Jane suggested notifying owners by letter that their townhomes should be checked to make sure they don’t have any interior problems after the harsh winter. This information was included in the 4/1/07 newsletter to members.
Reserve Study: Don asked for feedback from Todd. Todd shared his conversations with several owners who asked why the fees went up for 2006 and again in 2007. He shares with them a large amount is due to tree removal and adding reserves.
Jim Barnett stated that at the Four Seasons Racket Club condo they owned previously which was worth $130,000 – $140,000 they paid $6,000 a year in fees. Our fees are $3,000. He thinks it is actually very low. Jane said that if owners were reading the information provided by the board they would know why.
Don stated he thinks it is important we complete the reserve study by 6/1/2007. Jane said that she thinks we have all been associated with associations that have not reserved enough funds. Jim suggested having something on the bill that itemizes and shows the amount going to assessment, reserves etc so the member can see what is going into reserves. Don brought up that the pump reserves need to be kept separate, also. Don asked for agreement on having Todd put something together by June 1st. All agreed, including Todd.
Personal property tax on boat docks: 2/7/07, Brohm spoke to Camden Cty assessor Whitworth, no way out of this; all Camden County boat docks attached to common ground are handled this way. After previous discussion Jane Kruse sent a letter to Camden County Assessor Eddie Whitworth on 2/28/07 explaining that the POA would not comply with filling out the dock assessment forms as the POA does not own the docks in question. After Mr. Whitworth received Jane’s letter, he called Jane to discuss. Jane said, Mr. Whitworth started out angry, but did calm down. She doesn’t feel there was ever a resolution. She assured him we do not have any problem with taxing the docks, but we do not own them. Taxing the POA is not appropriate. Bill Manion shared exactly how the wording was on the assessment form and as an owner there wasn’t any question that you needed to declare your dock. The board concluded that a letter should be sent to Eddie Whitworth providing the names of owners with docks. Jane will draft the letter and send it to Todd to add the names and send to on Mr. Whitworth.
Snow Policy: The two inch snowfall policy was reaffirmed. Owners are to notify Todd if they are coming to the lake and they want their drive cleaned. This past year we worked on snow more often due to ice on driveways.
Porto Cima Fire Hydrants The current hydrant plans being worked on the Lakesites POA are in limbo due to opposition by Sunrise Beach and Lake Ozark to the annexation by the public water district of the area served by Lake Regional Water & Sewer.
Board Meeting Schedule: Meetings for the reminder of the year and the Annual meeting will be held at the Porto Cima Country Club. Todd will contact Michael Mally to make arrangements for the Club facilities on these dates.
